TMGUARD LTD (“TMGuard”, “we”, “us”, “our”) is committed to protecting your privacy. This policy explains how we collect, use, and protect personal data when you use our website (tmguard.uk) and trademark monitoring service.

1. What Data We Collect

Data you provide directly:

• Account information: name, email address, company name
• Trademark details: mark names, registration numbers, Nice classes
• Payment information: processed by Stripe (we do not store card details)
• Correspondence: emails forwarded to TMGuard for parsing, support enquiries
• Feedback: match relevance ratings, dismissal reasons

Data we collect automatically:

• Device and browser information (via cookies, if consented)
• Pages visited and features used (via Google Analytics 4, if consented)
• IP address (for rate limiting and security, not stored long-term)

Data from public sources:

• UK IPO trademark register data (mark names, classes, applicant names, filing dates, status)
• Companies House register data (company names, registered addresses, director names, SIC codes, filing history)
• Domain registration data (WHOIS/RDAP, domain availability only, no personal registrant data stored)

2. How We Collect It

• Directly from you: when you create an account, add watches, provide feedback, or contact us
• Automatically: through cookies and analytics (with your consent)
• From public registers: the UK IPO trademark register and Companies House register are public government databases. We access them through official APIs and published data releases.

4. Data from Public Sources

TMGuard processes data from the UK Intellectual Property Office trademark register and the Companies House company register. Both are public government databases.

If we contact you based on public register data (for example, to inform you that your newly registered company name conflicts with an existing trademark), we do so under legitimate interests. Our Legitimate Interests Assessment is available on request by emailing privacy@tmguard.uk.

What public data we hold:

• Company names, numbers, registered addresses, SIC codes, and director names (from Companies House)
• Trademark names, application numbers, classes, applicant names, and status (from the UK IPO)

This data is already publicly available. We process it to identify potential trademark conflicts and provide monitoring services.

5. How We Use AI

TMGuard uses artificial intelligence (powered by Anthropic's Claude) for:

• Analysing opposition decisions to extract outcomes, costs, and grounds
• Parsing forwarded IPO emails to extract deadlines and case details
• Assessing trademark conflict risk levels
• Generating plain-English summaries of complex trademark situations

What we send to our AI provider:

• Trademark names and filing details (public data)
• Opposition decision text (public IPO documents)
• Forwarded email content (only emails you send to TMGuard)

What we do NOT send to our AI provider:

• Your personal details (name, email, address)
• Your payment information
• Your account credentials

Our AI provider (Anthropic) processes data under their Data Processing Agreement and does not use TMGuard's data to train their models.

6. Who We Share Data With

We do not sell your data. We do not share your data with advertisers.

When you use the “Speak to a Trademark Specialist” feature, we share your match details and case packet with the solicitor you are being referred to. This only happens when you click the referral button, never automatically.

7. Where Data Is Stored

All data is stored in the European region:

• Database: Neon PostgreSQL (eu-west-2, London)
• File storage: Cloudflare R2 (EU)
• Hosting: Vercel (London edge)
• Email: Resend (EU processing)

Anthropic (AI provider) may process data in the United States under Standard Contractual Clauses and their DPA.

• Object to processing based on legitimate interests
• Withdraw consent for analytics cookies at any time
• Complain to the Information Commissioner's Office (ico.org.uk)
