1. The Service

TMGuard is a trademark monitoring and information platform. We provide:

Deadline tracking and renewal reminders
Draft document generation for review purposes

2. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must not share your account with others.

We reserve the right to suspend or terminate accounts that violate these terms or are used fraudulently.

3. Subscriptions and Payment

TMGuard offers paid subscription plans billed annually. Prices are listed on our website and may change with 30 days' notice.

Payments are processed securely by Stripe. We do not store your card details.

Cancellation:

You may cancel your subscription at any time through your account settings. Your access continues until the end of the current billing period. We do not offer partial refunds for unused time.

Free trial:

During any free trial period, selected users may receive free access. This may be revoked at any time with reasonable notice.

4. Free Brand Check (/check)

The free brand check tool at tmguard.uk/check is provided without charge for informational purposes. Results are based on algorithmic matching against our database and should not be relied upon as a definitive legal assessment.

The free check is rate-limited. Excessive automated use is prohibited.

5. Draft Documents

TMGuard may generate draft opposition or defence documents (TM7, TM7a, TM8) based on your input. These are starting points for your review, NOT ready to file.

7. Data Accuracy

Trademark data from the UK IPO is Crown Copyright and used under the Open Government Licence. Companies House data is used under the same licence.

10. Acceptable Use

You must not:

Use TMGuard to harass, threaten, or intimidate trademark applicants

Attempt to circumvent rate limits or access controls
Use TMGuard for any illegal purpose

11. Changes to Terms

We may update these terms from time to time. Material changes will be notified to active subscribers by email at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.

12. Governing Law

These terms are governed by the laws of England and Wales. Disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
